I found the xxl very comfortable. Not tight at all but just a good fit. I wear a 38 as well with a 32 inch inseam. I tried the xl and I found those to be a little too snug to be comfy.

I wear a size 31w 32l and im 6' what size would be recommended?

I would get a large, I bought an xl thinking with pants on a large would be to small, I was wrong the xl are way to big even with pants. I wear a 32x32 usually.

What size would fit 44 waist x 36 inseam?

You will be either a 3x or 4x. 4x if you like them roomy or plan to wear something thicker underneath. Hope that helps!
